Course Prescription
Course Overview
1. The foundations of public law: What is the underlying logic of public law in the modern liberal state? What are the virtues of democratic legislation? Which institution is best suited for developing the law today? Which institution can we trust to protect the rights of minorities and individuals?
2. Adjudication and legal reasoning: What is the proper role of the judge? What are the main techniques she employs in decision-making? Do judges simply promote their own political agenda? Do they exercise arbitrary discretion?
3. Law and morality: What is the relationship between law and morality? Can grossly immoral law still be valid? How should lawyers and judges deal with wicked law?
4. The dilemmas of private law: What legal rules are appropriate for economic life? What is the relationship between economic growth and individual freedom? What are the limits of liberal law? Does it have a dark side?
5. Critical theory: Race and third-world approaches to international law; law and disagreement; and pluralist jurisprudence.

Learning Outcomes
- Understand competing theories of: public law, legal reasoning, legal validity, and private law. (Capability 1.1)
- Evaluate and critically engage with legal controversies in light of the theoretical foundations of the law (Capability 2.2)
- Identify and analyse the disagreement as to different understandings of the relationship between law, morality, and politics. (Capability 3.1)
- Communicate and express complex theoretical concepts and develop persuasive arguments in favour of a particular theoretical position or viewpoint. (Capability 4.1)
- Demonstrate the capacity to reason about what is valuable about the law and what is required from legal actors. (Capability 5.1)
- Analyse the law and legal reasoning from a critical perspective, developing an understanding of the role that ideology might play in the formulation and application of the law. (Capability 6.2)

Workload Expectations
This is a standard 15-point course. There will be around 36 hours of lectures in this course. As a general guide, you should expect a workload of three hours outside of the classroom for each hour spent in class. The guideline for the total workload for this course is 150 hours.

Campus Experience
Attendance is expected at scheduled activities including tutorials to receive credit for the tutorial written work.
Lectures will be available as recordings. Other learning activities, including tutorials, will not be available as recordings.
The course will not include live online events including.
Attendance on campus is required for the concept reviews.
The activities for the course are scheduled as a standard weekly timetable.
Student Feedback
At the end of every semester students will be invited to give feedback on the course and teaching through a tool called SET or Qualtrics. The lecturers and course co-ordinators will consider all feedback and respond with summaries and actions.

Course materials are made available in a learning and collaboration tool called Canvas which also includes reading lists and lecture recordings (where available).

Academic Integrity
