Course Prescription

Explores substantive international and domestic human rights law and associated legal skills taught through a combination of seminars and experiential learning.

Course Overview

A clinical legal education course with a focus on gathering tikanga Māori based evidence for litigation and advocacy. Students will attend seminars and participate in wānanga (workshops) and trainings to better understand this topic and then work alongside legal practitioners to apply these skills in a real-life context. The course will involve a mix of classroom, workshop and experiential learning.

Prerequisite: LAW 211 or 30 points at Stage II in Global Politics and Human Rights

Learning Outcomes

By the end of this course, students will be able to:
  1. Identify, critique and evaluate the challenges associated with gathering and submitting tikanga Maori based evidence in court. (Capability 1.1, 1.3, 2.1, 2.2, 2.3, 6.1, 6.2 and 6.3)
  2. Experience gathering tikanga Maori based evidence for litigation or advocacy. (Capability 2.1, 2.2, 2.3, 3.1, 3.2, 3.3, 4.1, 4.3, 6.1, 6.2 and 6.3)
  3. Experience working with lawyers and tikanga experts to be able to present tikanga evidence in a way that is consistent with tikanga principles and also relate to legislative and common law tests. (Capability 3.1, 3.2, 3.3, 4.1, 4.3, 5.1, 5.2 and 6.2)
  4. Develop an ability to support the drafting affidavits alongside practitioners to assist with the submission of tikanga Maori based evidence. (Capability 4.1, 4.2 and 4.3)
  5. Develop personal skills and aptitudes including: a capacity for empathy for target audiences from different backgrounds; a willingness to take a risk and the ability to deal with failure; self-reflection habit; and professional interpersonal skills (personal development). (Capability 4.1, 4.2, 4.3, 5.1, 5.2, 6.1, 6.2 and 6.3)

Workload Expectations

This is a standard 15-point course. There will be around 36 hours of wānanga, seminars and contact time with practitioners in this course. As a general guide, you should expect a workload of three hours outside of the classroom for each hour spent in class. The guideline for the total workload for this course is 150 hours.

Delivery Mode

Campus Experience

As this course is experiential in nature and much of the learning will be gained through in-person attendance, attendance is required for all workshops, trainings and experiential learning opportunities.

Attendance is expected for seminars.

Lectures will be available as recordings but not workshops, trainings or experiential learning opportunities.

The activities for the course are scheduled as a standard weekly timetable although, given the experiential nature of the learning, there will be weeks where there are no in-person seminars and, instead, tasks to be completed with practitioners and/or lecturers.
