Course Prescription

A critical understanding of the concepts and principles relevant to urban planning legislation, practice and decision-making, including the Resource Management Act 1991, Local Government Act 2002, Land Transport Management Act 2003, Climate Change Response Act 2019 and Urban Development Authority Act 2020.

Course Overview

The principal objective of this course is to give students a critical introductory understanding of selected legal concepts, institutions, instruments and processes relevant to planning in New Zealand. The primary focus will be on the Resource Management Act 1991 and Local Government Act 2002. A range of other legislation together with new policy  developments, important for urban planning, will be introduced. As the legislative context is rapidly changing, this course will prepare students to understand how the resource management regime may look in the future.

Note - two of the above pieces of legislation have been incorrectly referenced in the Calendar. The correct references are: Climate Change Response Act 2002 and Urban Development Act 2020.

Learning Outcomes

By the end of this course, students will be able to:
  1. Understand and critically evaluate key aspects of the Resource Management Act and other planning legislation, as time allows. (Capability 1.3, 3.1, 3.2, 4.1 and 4.3)
  2. Understand and critically evaluate evaluate the regulatory approach to planning in the context of climate change.
  3. Demonstrate an understanding of of legal reforms and statutory instruments applicable to urban planningin the Auckland region.
  4. Develop and demonstrate an ability to read and apply case law to current planning issues
  5. Explain and critically evaluate new legal developments relevant to urban planning governance and law.

The Urban Planning programme policy requires ALL elements of course assessment to be submitted by the due date/time, to pass this course. This applies to ALL assignments, tests and examinations (excluding the Quiz). An extension of time for late submissions will be considered on medical and special grounds when supported by a health or other professional, and when the application is made according to the procedure below. Any coursework not received by the due date and time, and for which no extension of time has been approved, will receive the grade ‘DNC’ (Did Not Complete). A DNC for any one piece of course work will result in a DNC for the WHOLE course. A DNC for the course is a FAIL.

Workload Expectations

This course is a standard 15 point course and students are expected to spend 10 hours per week involved in each 15 point course that they are enrolled in.

Preparation for lectures: approximately one - two hours preparation is expected for every one hour of lecture time. You will be required to complete readings in preparation for class. However, students are encouraged to add more time for background and contextual reading. 

No tutorials.

You should spend an additional 8 hours per week on background reading around topics related to lectures, participation in and writing up the assignment, together with test and exam revision.

Delivery Mode

Campus Experience

Attendance is expected at all lectures and any scheduled activities to complete components of the course. Lectures will be available as recordings. The course will not include live online events. Attendance on campus is required for the test and examination. The activities for the course are scheduled as a standard weekly timetable.

Learning Resources

Course materials are made available in a learning and collaboration tool called Canvas which also includes reading lists and lecture recordings (where available).

Please remember that the recording of any class on a personal device requires the permission of the instructor.

Student Feedback

At the end of every semester students will be invited to give feedback on the course and teaching through a tool called SET or Qualtrics. The lecturers and course co-ordinators will consider all feedback and respond with summaries and actions.
